A proteção judicial dos consumidores contra danos decorrentes de violações do direito da concorrência é ainda uma realidade quase inédita ou menos divulgada em Portugal. Nesta palestra, a convite do Prof. Doutor Luís Morais, do Instituto Europeu e do IDEFF da Faculdade de Direito da Universidade de Lisboa, numa iniciativa a que se associa também a Prof.ª Doutora Leonor Rossi, da Faculdade de Economia e Gestão da UNL (em cooperação entre as duas Universidades) o Prof. Doutor Barry Rodger, da Faculdade de Direito da Universidade de Strathclyde, apresentará os resultados de um projeto de investigação europeu, por si coordenado, que identificou os precedentes do chamado “private enforcement” do direito da concorrência, nos 27 Estados-membros, analisando-os, especialmente, na ótica da sua contribuição para a proteção dos consumidores.

Será apresentado, pelo Prof. Doutor Luis Silva Morais que abrirá os trabalhos com a Prof.ª Doutora Leonor Rossi, expondo os objectivos do Seminário. A exposição do Prof. Doutor Barry Rodger, será precedida por uma breve apresentação pela Prof.ª Doutora Leonor Rossi e pelo Dr. Miguel Sousa Ferro, da Faculdade de Direito da UL, autores do relatório nacional incluído neste estudo e versando o mesmo relatório referente a Portugal. Pretende-se que a sessão dê a conhecer a realidade europeia e nacional, proporcionando um fórum para a discussão das causas e soluções possíveis para as lacunas identificadas, bem como para o esclarecimento de dúvidas relativas à prática judicial.

Judicial protection of consumers from damages arising from infringements of competition law is still practically inexistent or at least not widely known or discussed in Portugal. In this lecture, following an invitation from Prof. Luís Morais, of the European Institute and IDEFF of Lisbon Law Faculty (FDL), in a joint initiative with Prof. Leonor Rossi of the Nova School of Business & Economics, Prof. Barry Rodger, of Strathclyde University Law School, shall present the results of a European research project he coordinated, which identified the precedents of private enforcement of competition law in the 27 Member States, analyzing them, especially, in what concerns their contribution to consumer protection.

He will be introduced by Prof. Luís Silva Morais, who will open the proceedings together with Prof. Leonor Rossi, presenting the key goals of the Seminar. The lecture of Prof Barry Rodger will be preceded by a brief presentation by Prof. Leonor Rossi and Miguel Sousa Ferro, of the of Lisbon Law Faculty (FDL), authors of the national report included in this study, which will cover that report on Portugal. The aim of the session is to describe the European and national reality, and to create a forum for the discussion of the causes and possible solutions for the shortcomings identified, as well as for the clarification of doubts relating to judicial practice.

Short Biography (Prof Barry Rodger)

       Prof Barry Rodger has been an academic at Strathclyde University Law School since 1993 and has been a Professor there since 2001. Professor Rodger is a member of the organizing committee of the Scottish Competition Law Forum and is the Vice-Chair of the Competition Law Scholars' Forum (www.clasf.org) and co-editor of the Competition Law Review.

     He has published widely in competition law. Many of his recent publications have focused on private enforcement of competition law including his comprehensive study of all competition-related litigation in the UK courts (ECLR 2006). He is currently finalizing an AHRC funded project on Comparative Competition Law Private Enforcement and Collective Redress in the EU (see www.clcpecreu.co.uk).
